General Terms & Conditions YELLOW TOURISM SOLUTIONS N.V. INSURANCE All Tours and Activities undertaken by customers are of their own choice and at their own risk. These include such activities as snorkeling, Scuba diving, cliff jumping, hiking and all other water & beach related sports during the Tour/activity Services. Yellow Tourism Solutions N.V. shall not be responsible for any personal accidents which may occur during the above stated activities. Travel Insurance Customers are responsible for their own Travel Insurance, relative to medical costs, personal accident and personal loss. Yellow Tourism Solutions N.V. will not be liable if anyone should fail to take an adequate Travel Insurance cover prior to departure from the country of domicile. During on-island transportation all customers in the vehicles of Yellow Tourism Solutions N.V. and/or Island Style Events & Services are properly insured under the local transportation insurance policies. Third parties Yellow Tourism Solutions N.V. is not responsible for the insurance of third party operators which are being sold through the Tour Info Centers of Yellow Tourism Solutions N.V. All customers which have booked a tour/activity through the Tour Info Centers will join at their own risk. If an accident of any kind may occur, the Local Jurisdiction (Netherlands Antilles) will be applied during a possible case.
RESPONSIBILITY CLAUSE Luggage Yellow Tourism Solutions N.V. will not be held responsible for the loss or damage to equipment and personal belongings due to the customer’s own actions. Yellow Tourism Solutions N.V. will not be held responsible for loss or damage to equipment and personal belongings due to circumstances beyond our control, such as rainy weather, swimming with non water proof devices, damage to equipment by sand or stones. Under no circumstances is Yellow Tourism Solutions N.V. to be construed as a carrier under contract for safe carriage of his or her luggage and belongings. Luggage and belongings are carried at customer’s own risk, these being advised to closely watch the possible loading and unloading of their belongings. Rental equipment Yellow Tourism Solutions N.V. has the authority to claim the cost of repair for any damages caused by the customer to the rented equipment such as snorkel gear and inflatable devices. Behavior Any customer that, in the opinion of the tour/activity organizers or crew of Yellow Tourism Solutions N.V., presents a danger to himself or herself or to others may be asked to leave the tour/activity. No customer will be asked to leave the tour/activity without cause, however, nor without receiving reasonable opportunity to comply with safe and responsible behavior. Anyone under the age of 16 must be accompanied by a responsible adult. There is no refund for anyone removed from the tour/activity. When removal occurred, transportation to the hotel is at the customer’s own cost. Medical responsibility Good physical- and mental health are essential for the enjoyment of the Tour/activity Services. All customers have to come in good condition. It is essential that any customer with a medical condition requiring regular treatment or which may be affected by vigorous activity, high altitude, heat, cold, other natural phenomena, or foods, notify Yellow Tourism Solutions N.V., in advance of the tour/activity. All customers must carry their own medical insurance, valid for the duration of the tour/activity.
Customers Requiring Special Assistance
Yellow Tourism Solutions N.V. regrets that it cannot provide individual assistance to a tour/activity customer for walking, swimming or other personal needs. Customers who need such assistance must be accompanied by a qualified companion.
CANCELLATIONS AND REFUNDS Deposits For administrative and operational reasons, no refund can be given on a deposit when tours/activities are cancelled by the customer. In case of NO SHOW, due to the customers own responsibility, no amount will be refunded. Payments in full If the customer finds it necessary to cancel his/her reservation within 48 hours, prior to tour/activity departure, Yellow Tourism Solutions N.V. will retain 50% of the payment. All requests for refunds will be considered promptly. Cancellations by company Yellow Tourism Solutions N.V. reserves the right to cancel the tour/activity because of insufficient registrations or unforeseeable circumstances. All payments will then be refunded and/or suggestions for other comparable tours/activities will be given. Payments (Deposits and/or amounts in full) must be received at the location of reservation at least 48 hours prior to tour/activity departure. All payments must be in the form of U.S. dollars or Antillean guilders.
If payment is not received when due (48 hours prior to tour/activity departure), Yellow Tourism Solutions N.V. reserves the right to treat the reservation as cancelled. If for any reason a customer is removed from the tour/activity, he or she will not receive a refund of the used services as stated above in the responsibility clause section.
TOUR/ACTIVITY MODIFICATION Yellow Tourism Solutions N.V. designs its tour/activities with a degree of flexibility, to provide you with the best possible opportunity for exploring Curaçao. However, circumstances may arise which would require an adjustment to the tour/activity due to weather, availability of routes, problems with old routes, etc. Yellow Tourism Solutions N.V. will do all that is possible to avoid such changes, but it must reserve the right to make such modifications if they are determined to be necessary.
PRICES & VOUCHERS Prices Yellow Tourism Solutions N.V. reserves the right to change the prices of the tour/activity without official notification. All prices are in US dollars ($) or Antillean guilders (ANG. or NAFL.). Dollar rate Yellow Tourism Solutions N.V.: 1 US dollar = ANG. 1,75 Children: 4 - 12 years of age. Adults: above 12 years of age. Vouchers Only customers with a valid voucher purchased or received at an official reservation or distribution desk is allowed to make use of the tour/activity offering of Yellow Tourism Solutions N.V.
GENERAL Smoking is prohibited in all vehicles. Beverages of any kind are prohibited in the transportation vehicles. Littering the surroundings will not be tolerated and can lead to immediate termination of the tour/activity! Gratuities: Tips are not required or included in the tour/activity price because Yellow Tourism Solutions N.V. believes they should be entirely a matter of personal discretion on the part of our customers. | |||||||||||||||||
